Housing Notice and Tense Area: The Legal Framework Conditioning the Entire Timeline

The notice period remains the first hurdle of the project. In an unfurnished rental, the default notice period is three months, reduced to one month in municipalities classified as tense areas. End of MOBILI-PASS: Moving Budget and Remaining Assistance

The MOBILI-PASS assistance from Action Logement was suspended on July 1, 2023 and has not been renewed since. This scheme covered a significant portion of the costs related to professional mobility (housing search, agency fees, temporary double rent). Its disappearance radically changes how to budget for a move in the context of a transfer or hiring in another city.

Concerned employees must now rely on two remaining schemes:

  • The Loca-Pass advance, a zero-interest loan intended to finance the security deposit, repayable over a period of up to several years.
  • The Visale guarantee, which substitutes for a physical guarantor with the landlord and secures entry into the new housing.
  • Local assistance (departmental council, CPAM for large families, pension funds), whose eligibility varies greatly depending on the territory and the applicant’s situation.

We find that many employees discover the removal of the MOBILI-PASS when they are compiling their files. Incorporating this parameter from the start of the project avoids a cash flow gap during the move.

Operational Sequencing of Boxes and Logistics

Packing is the area where disorganization costs the most, not in euros, but in time lost on loading day. Starting with off-season items and little-used rooms (garage, attic, library) four to six weeks before the planned date frees up maneuvering space for the rest.

The choice of packing materials is not trivial. Double-walled reinforced boxes protect dishes and fragile items much better than recycled boxes, whose thickness and moisture resistance are unpredictable. Each box should have a label indicating the destination room and the nature of the contents, not just “kitchen” or “bedroom” but the functional detail (“dinner plates,” “winter sheets”).

For electricity and gas, planning the activation in the new housing at least two weeks before moving in ensures that heating or hot water is available upon arrival. In the case of a Linky meter, activation can be quicker, but timelines vary by provider.

The home insurance for the new housing must be active on the day the keys are handed over, not on the actual moving day. This is a legal obligation for the tenant and a common condition for signing the lease. We recommend subscribing to the new contract in parallel with terminating the old one to avoid any coverage gaps.

The mail forwarding service offered by La Poste operates for a duration of six months or twelve months. Activating this service at least one week before departure allows for capturing administrative mail sent to the old address, including tax notices or bank statements. At the same time, the change of address declaration with public agencies (taxes, social security, benefits office) can be done online via the official service.

Exit Inventory: Preparing the Housing to Avoid Deductions

The exit inventory conditions the return of the security deposit. Cleaning the walls, filling in screw holes, and descaling sanitary equipment are simple actions that significantly reduce deductions.

Marks from furniture on soft floors (PVC, linoleum) are considered normal wear if the occupancy lasted several years. However, a paint stain on a parquet floor or a cracked window constitutes damage and justifies a deduction. Photographing each room on the day of the inventory, with timestamps, serves as usable evidence in case of disputes.

The landlord has one month to return the security deposit if the exit inventory matches the entry inventory, and two months in case of discrepancies. Knowing this timeframe prevents premature follow-ups and deteriorates the relationship with the owner.
